Terms and Conditions

This website is intended for the use of the trade professional and DIY enthusiast and should be used in conjunction with your original factory parts catalogue. Your use of this website and any service contained within constitutes acceptance of these Terms & Conditions. These Terms and Conditions apply to all transactions. Please read them carefully. They do not affect your statutory rights. We may change these terms and conditions at any time. Any changes will take effect on the date they are posted.

By using and ordering online, by telephone or other mail order you are in agreement and accept our terms and conditions, If you do not understand or accept any of our terms and conditions you should cancel your order or you may contact us at any time for clarification before you place a order

Any reference to company/seller/we/us shall mean British PartsUK who sell or supply parts and accessories suitable for Jaguar and Land Rover vehicles Any reference to You/Buyer/Purchaser shall mean any person, sole trader, partnership, business, body corporate or other entity detailed in the appropriate section of the sales invoice/order form and shall include all successors, heirs and assigns. Where the Buyer purchases in the course of a trade, profession, vocation or sport (where the buyer is a specialist or enthusiast), it is agreed that such a buyer shall mean a trade buyer. Where a person deals entirely as a consumer, statutory rights shall remain unaffected. Where the term buyer appears within these terms it shall mean both trade and consumer buyer/purchaser unless specified as relating to a trade buyer or consumer buyer individually. Goods or equipment ordered shall mean the items detailed in the appropriate section of the sales order form and it shall be a core term of this agreement that all additional parts, connecting components or ancillary items, not detailed within the sales order form, shall be additional to this agreement.

Acceptance of Order

If you have provided us with a functioning email address, we will notify you by email as soon as possible to confirm receipt of your order. Our acceptance of your order in its original or revised format will take place upon dispatch of the products ordered. We reserve the right to cancel amend or refuse any order.

Customer Information

You should always check that the contact information you provide is correct before creating a customer account or proceeding to payment. You are responsible for maintaining your own username and password, where required to access your customer account. You should ensure that you store your username and password securely and that the details required to access your customer account are not provided to another party. As a customer you are responsible for your customer account and actions taken within it. If you are aware or suspect that your customer account username and password or other details have become known to a third party, you should inform us immediately. We will retain your personal information for the purposes of processing and delivering your order. Your Name, address and order history will be retained for a period of not less than 7 years.

Product Pricing and Title

We make every effort to ensure that the pricing displayed on our website is correct. However, if an error in the pricing of a product is found we reserve the right to either cancel your order or contact you to arrange payment of any extra sum due or refund any over-payment made by you (as applicable). The processing of an order can be cancelled or corrected by us at anytime up to the shipment of that order and any related items. We reserve the right to alter all product pricing without notice. Title in any products ordered from us does not pass to you, the purchaser until we have received and processed a valid payment, and that payment has been made into our own bank account and your order has been shipped and delivered. All prices are plus VAT at the current rate where applicable

Your Order

When you place an order you will automatically receive a confirmation email from us to confirm your order. Your order constitutes an offer made to us to purchase the goods specified in the order. Your offer is only accepted by us once we have emailed you to confirm the dispatch of your order. Product items not included within the dispatch email are not included in the order and contract between you and us. We reserve the right to delay or refuse orders where a transaction contains incomplete details or details that cannot be verified or where fraud is suspected. If we are unable to reasonably ascertain these details or resolve these issues a full refund will be made against the card used at the time of purchase. No other form of refund or credit will be offered nor will a refund be made to any third party card or account.

Telephone orders are taken in good faith and are processed with the information provided at the time of the order and how are sales people understand the information

Prices and Payment

All prices and charges on this site are in GB pounds. The total cost of your order will be the price of the products you have ordered, plus any applicable delivery charges and vat where applicable. All these will be set out clearly in your Shopping Cart before you submit your order. Prices, offers and products are subject to availability and may change before (but not after) we accept your order. If something becomes unavailable we will send you an alternative in which case the price may vary, we will inform you of any price changes prior to processing your order. Brand names & images are displayed in all good faith, We will select an appropriate alternative unless instructed otherwise. We try very hard to ensure that all information on this site is accurate. However, just occasionally, an error can occur If we discover an error in the price or description of a product you have ordered, we will tell you and ask you whether you wish to continue with your order or cancel it. For payment we accept Master card, Visa or bank transfer. Payment is deducted when we process your order but we do reserve the right to refuse any form of payment we feel is not secure All prices are plus VAT at the current rate where applicable

VAT - UK & EU orders

All prices are plus vat at the current rate, this applies to all UK & EU orders but excludes Jersey, Guernsey and all other EU exempt areas

EU - VAT Exempt orders

VAT is charged on all sales to EU countries however companies registered in the EU can have the vat removed from the transaction ( zero rated export ) to qualify for a vat zero rated transaction you must send to us a copy of your companies vat certificate for us to keep on file. Please be advised that we are only able to deliver to the name and address of the company which is on the vat certificate

Shipping and Customs Duty

All orders received by us are shipped subject to availability. We reserve the right to ship products at a later date (up to 28 days after purchase) where the product ordered is not in stock at the time of purchase. In this situation you may be contacted and offered a full refund instead of delivery of the product. We do not accept any liability for disruption to shipping caused by industrial disputes or action outside our control. If such disruption occurs you will be offered delivery via an alternative delivery or fulfilment company or a full refund. Taxes and import duty is payable at the point of entry or delivery to most countries worldwide and we have no control over these charges

Delays

Occasionally, delivery of your order may be delayed or postponed. We will, of course make every effort to keep you informed and discuss revised delivery timescales, we do accept no liability whatsoever for delayed or lost orders. If you are ordering a product from outside the UK the recipient of the product is responsible for all customs duties or tariffs incurred in the country to which the products are shipped. Furthermore your order may be subject to delay or be opened and searched by local customs authorities when entering the destination country. Please note we are unable to provide specific advice on customs duties or tariffs. Delivery times are only a estimate and cannot be guaranteed

Export Sales

All export sales are final and not returnable unless defective or incorrectly supplied by this company, however should a return be accepted you are responsible for paying any postage or shipping costs incurred when returning the product and its safe arrival at our works.

Availability

From time to time, products may not be in stock. If a product is out of stock, we will contact you and advise you of the delivery date if possible before processing your order, alternatively we may part ship the balance of your order with the rest to follow

Cancelling Orders

Should you want to cancel your order prior to dispatch you must confirm this by email and by telephone however due to the high volume of parcels we dispatch every day it may not always be possible to catch and cancel your order. Should your order still be dispatched and delivered it must be treated as a return and the appropriate procedures followed

Cancellation Rights, Returns and Refunds

As of June 13th 2014 all sales with British Parts are subject to the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 applies to orders delivered within the United Kingdom

Please note the customer or purchaser is responsible for the costs of all returns

No right of cancellation exists for personalised goods or goods that are intimate in their nature or goods where there may be hygiene issues, unless defective or goods that have been specially ordered for you. Please observe the following procedure for all returns to us: Please complete our returns form and send it together with the part (s) you are returning If you are returning your product because it is defective, please state the defect or defects. Repackage the product in its original packaging, including any accessories, brochures, manuals, guarantees or warranties that came with the product. Unfortunately we will be unable to issue a refund where the product is in an incomplete state. If the original packaging surrounding the product has been damaged or destroyed we will only issue a refund if the product is being returned due to a defect. If the original packaging of a defective product has been damaged or destroyed you should ensure that the returned product is adequately packed for shipment back to us. You are responsible for paying any postage or shipping costs incurred when returning the product and its safe arrival at our works. We recommend that all returns be sent by registered post, so that a record of the return is available for you. We will not issue refunds for any items damaged, lost or stolen in transit to us. Where a return is damaged, lost or stolen in transit to us, you should claim compensation from the company that shipped the return. If you fail to return a product to us, we may make arrangements to have the product collected from you. The cost of this collection will be charged to you. Unused products may be returned promptly by customers within 14 days of receipt to our address listed in the contact details of our website, We accept no returns after 14 days of receipt of goods The customer is responsible for the costs of all returns.

Returns Handling Charges

It is the customers responsibility to ensure any returns reach us in a saleable condition, If a part or component is returned to us and the value has been diminished because the packaging or branding is damaged or is incomplete in any way your refund will be subject to a 20% handling charge. If the value of the part or component returned has been returned damaged or in a condition that is not fit for resale no refund will be processed, under these circumstance the part or component will be held for 7 business days pending your instruction after which it will be disposed of without further notice

Customer Complaints

We endeavour to respond to all customer complaints or queries within five working days.

Faulty Products

Where a Customer experiences a fault with a product it can be returned to British Parts subject to our returns policy Liability & guarantee is limited to the repair or replacement of the faulty or failed component (s) and cost is limited strictly to the cost of the original part (s) as supplied in your invoice and will not be exceeded. We do not accept claims or charges for Installation, service or repair or any other costs, charges, claims relating to the faulty product or its return. Where we agree to cover the cost of returning a faulty part, the price for returning the faulty part is expressly limited to no more than the original delivery charge

Delivery Charges

UK Flat rate delivery charge applies to online orders only and is subject to change depending on weight and volume of parcel plus may vary depending on location Aternative Delivey Address Please note we are only able to deliver to the billing address of the credit card holder unless prior arrangements have been made and authorised by us or you are a established customer, However alternative delivery address's are entirely at our discretion

How we Deliver

Most products are delivered either by courier generally DHL or Interlink depending on their size and value. All orders will need to be signed for on delivery, please ensure that a responsible person is available to inspect and sign for the parts you have ordered. Delivery times are only a estimate and cannot be guaranteed. It is the customers responsibility to open and inspect the parts delivered claims for damage or shortages must be notified to us in writing within 24 hours of delivery.

We will not consider any claim for damage or shortages received after 24hours of delivery

Delivery times United Kingdom

Our delivery aim for most areas of the UK is next business day, this excludes but is not limited to Scotland Scottish highlands, Northern Ireland, the Channel islands, all offshore and remote locations Our dispatch team do try and send all orders where possible the same day but this may be affected during peak periods or other factors such as stock control or constraints by our couriers Delivery times are calculated in working days - i.e. Monday to Friday inclusive (but excluding bank holidays). If you order after 3.00pm, please calculate your delivery time as if your order had been placed the following working day Standard Postal and Courier Deliveries are normally 1 - 3 Working Days depending on the service used but this may be affected by weight and dimensions of your delivery. IMPORTANT: We do everything we can to meet delivery times and our customers expectations however, occasionally delivery times may be affected by factors beyond our control and therefore they cannot be guaranteed. Please allow extra time for deliveries to Scotland, Scottish islands, Northern Ireland and the Channel islands and all remote and offshore locations. Delivery times are only a estimate and cannot be guaranteed

Delivery times EU

Most EU destination parcels are sent via European road service DHL or DPD and delivery time is approximately 2 to 5 business days from the time of dispatch. Some areas of Europe mainly non EU countries it is only possible to dispatch packages by Express air service and delivery on these packages is normally within 2 to 3 days. Some areas are deemed 'remote areas' by our couriers and may incur a 12.00 GBP remote area charge. Delivery times are only a estimate and cannot be guaranteed

You can add or remove any items that you have selected for purchase at any time, You will have an opportunity to check and correct any input errors in your order up until you click the Submit Order button. After you submit your order you will receive a automated Order confirmation and details of the products you have ordered. Please note that this is a acknowledgement, not a acceptance of your order. we may decline all or part of your order for any reason, in which case a email will be sent to you with the details We will tell you if your payment cannot be authorised for any reason and may invite you to pay by another method Missing and or damaged Goods If the box that contains your parts arrives by courier damaged you should refuse the package and notify us immediately You must check your order upon receipt and notify us of any shortages or damaged parts within 24 hours of your order being delivered, claims received after this period will not be accepted Incorrect or damaged Parts returned for exchange, You will be charged pending safe return, inspection and acceptance of the incorrect parts, this you hereby authorise

Cancellation and Returns

We do not accept for return under any circumstances any electrical product, CD discs, software, literature, upholstery carpets, floor mats or any engine components Parts specially ordered for you and correctly supplied can not be returned for refund, credit or exchange

Returning Unwanted Parts

You can return unwanted parts for refund or credit within 14 days of purchase or delivery date. Your returning product must be complete, unused and in 'as new' condition (eg, if you have opened the box to examine the product you must have done so without damaging or marking the product in any way). It should be returned with the original box, packing and accessories plus any installation instructions.

Return of Faulty Goods - Delivery Items

The following are guidelines for all goods ordered for delivery, or collected from our warehouse If there is a fault with your product within 90 days of delivery (or other defect with your order), we will normally offer a prompt repair or exchange subject to verifying the defect. We will always offer you the choice of an exchange or refund if the fault occurs within 28 days of delivery ( subject to verifying the defect ). To qualify for a refund or exchange the product must be in otherwise in 'as new' condition complete with any accessories and the original box and packaging with completed returns form and copy invoice.

Guarantee

Our guarantee applies only where products purchased have been used solely for the intended purpose and correct application has not been, modified used in any form of motor sport or used for any other purpose than its original application The products we sell are covered by the manufacturers guarantee usually a period 6 months. Please contact us immediately should any problem occur. Guarantee does not cover installation charges, loss or damages of any type which are expressly excluded from this guarantee, failure of a related component, failure resulting from faulty installation or misuse. Liability will not exceed the cost of the original component.

THIS RETURNS POLICY DOES NOT AFFECT YOUR LEGAL RIGHTS

Lost Orders / Late Delivery

On occasion some deliveries can appear lost or mis routed by our carriers, we have to abide by our couriers terms and conditions and quite often there is a waiting period of up to 30 days before a parcel is deemed lost or can be claimed for, In the event that your parcel is delayed or lost by our carriers we may offer to re send the order but you will be charged again pending full investiagation and the courier accepting that the parcel is permanently lost, once the lost parcel is deemed permanently lost usually a period of 30 days you will be refunded in full the additional charge.

Waiver Failure by British Parts to enforce any accrued rights under these Terms & Conditions is not to be taken as or deemed to be a waiver of those rights unless we acknowledge the waiver in writing. Entire Terms & Conditions These Terms & Conditions set out the entire agreement and understanding between you and British Parts, We reserve the right to change these Terms & Conditions at any time, without giving notice to you. These terms and conditions and all transactions relating to this website are governed by English law and are subject to the non-exclusive jurisdiction of the English courts.
